“Black Pad” footpath at Toton Sidings – please help

Many of you will be familiar with a footpath that runs along the embankment at Toton Sidings connecting Bessell Lane, Stapleford, in the north with a footbridge over the railway near the Long Eaton ASDA store in the south. Although this footpath is heavily used every day, there is no legal right to use it, and the access points have recently been obstructed by British Rail prior to the sale by auction on December 3rd.

If it can be proved that the public has enjoyed this right of way without hindrance from the previous landowner (British Rail) for a period of more than 20 years, it may be possible to establish this footpath/bridleway as a legal right of way.

A formal application has been made to Jenny White, Definitive Map Officer, Countryside Access Department, Notts County Council for the addition of this route to the Definitive Map. Confirmation of use in support of this claim from walkers, cyclists, horse riders, or runners who have used the path for 20 years or more will be most welcome.

Please assist by completing a Public Rights of Way User Evidence Form [PDF 300KB] together with a map defining your route, copies of which are available from Jenny White, Definitive Map Officer, Notts County Council on telephone: 0115 977 4702. For further information on the background to this issue please contact Mavis Daykin on 0115 939 4080.
